Mediation offers a flexible and effective process to undertake dispute and conflict resolution. The mediation process will be approached depending on the requirements, concerns and interests of the parties involved.

OUR MEDIATION SERVICES

At Bendigo Mediation we specialise in using the mediation process to assist in situations where people are unable to resolve a dispute. Mediation is a confidential and voluntary process that involves a structured discussion between two or more parties in the presence of a neutral third party, the mediator.

 

Mediation is not about apportioning blame or deciding who is right or wrong.
The role of the mediator is to help both parties to:

  • Have a chance to be heard equally and fairly.
  • Work out what issues are important to each party and why.
  • Find areas of agreement and common ground.
  • Work with both parties to help find solutions for identified issues.

In mediation, it is up to each party to negotiate and find workable solutions for the issues between them. A mediator WILL NOT take sides, give advice, make decisions for you or tell you what agreement you should make.

 

There are many benefits to using mediation as opposed to taking your dispute to the Courts.
These include:

  • Confidentiality: mediation is private and confidential, with the exception of the mediator’s duty of care. Whereas, going to court is not.
  • Cost: mediation costs are a small fraction of court costs.
  • Time: mediation can usually be arranged at short notice, as opposed to the Courts where waiting lists can be years in length.
  • Self-Determination: you and the other party reach an agreement. The outcome is not determined by an external their party like a judge.
  • Flexibility: mediation is a flexible, informal process. Unlike court processes which are very formal and controlled by a judge.

 

Mediation can be used to resolve conflict in a variety of situations.
