Family Law Mediation also known as Family Dispute Resolution (FDR) is a pre-court process whereby separating parents or carers engage in a well-meaningful discussion, about the needs of their children and financial matters.

We help parents and carers to communicate and work with each other on issues relating to their children, property division, financial matters and parenting plans.

Frequently Asked Questions

  • The Family Law Act Cth (1975) has now made it mandatory for parents, grandparents and significant parties who wish to approach the Family Court in relation to parenting and children's matters to first attempt family dispute resolution unless you are entitled to an exemption from mediation due to eg, urgency, incapacity, child abuse or family violence or a risk of same.

  • If you have been invited to mediate by the initiating parent and you do not wish to participate no one can force you to take part. Participation is voluntary.

    If you choose not to take part the initiating parent will be offered a certificate Section 60i which will allow them to explore further legal options and make an application to the Family Court.

    We recommend you get legal advice if you would like to explore your options and to understand any consequences if you choose not to participate.

  • If appropriate and safe to do so Family Dispute Resolution can occur if there has been family violence. Thorough safety and assessment screening takes place as well as other alternative arrangements to ensure safety at all times.
